I have found that the install scripts don't work correctly at times. I had problems installing some 4.01 updates and could only get them to work if I uninstalled 4.00 first.

Have not updated all my games previously so I just ran the 4.02 update to check this and it is showing 4.02 after the update for me with cph.exe showing a creation date of 3/31/2023 2:20 PM.
If yours does not show the same something went wrong in your update.

Thanks Ken... I finally got it, but not until after I uninstalled and reinstalled the game with 4.02 in the installer. No idea what was up; I'm not installed in the default directory, but I know I specified the correct path.

I'm up now

The Mixed Organization Penalty takes into account the coordination of two regiments assaulting the same location in the game. I like it for that reason. It was hard in the ACW for two different brigades to coordinate their attacks. I have played board games that had a "Coordinated Assault" rule and it worked fine. This rule is also in the Panzer Campaigns series and its been that way for a long time.

I would say this: if the Division commander is present in the same hex as the two units OR in ONE of the hexes that is attacking, then the rule should be void.

But its a way of cutting down on commanders just tossing in any old regiment. I guess its a matter of preference and I certainly would not stand firm on this optional rule during pre-game negotiations. I would expect my opponent to make some kind of concession to my choices where they disagree.
